山陰地方の養護老人ホームにおける成年後見制度の実態に関する研究

本稿は，介護保険制度の創設につながる一連の社会福祉基礎構造改革をめぐる文脈を整理し，その影響を受ける成年後見制度の意義と必然性を，経済学的な立場から理論的に整理した。そのうえで，山陰地方A県の養護老人ホームにおける成年後見制度の実態に関わる問題を検証した。養護老人ホームにおける成年後見制度の浸透は進んでおらず，その背景には，措置制度時代からの慣習により，施設が金銭管理や契約代行等の支援を継続している実態があることが明らかになった。成年後見制度の対象となりうる者が不利益を生じないよう生活できる成年後見制度を充実させるために，それを支える枠組みの整備が急がれる。

In this article, we organized the context of a series of basic social welfare structural reforms connected to setting up the long−term care insurance and next organized in a logical manner the significance as well as the necessity of the adult guardianship that was affected by the above reforms. Then, we reviewed actual problems of the adult guardianship used in a nursing home which was located in A Prefecture of the San−in region. In this nursing home, the adult guardianship was not actively utilized. We clarified the most important reason for it: It remains permitted by people of a welfare facility and government bureaucrats as well that family actually proceed an application of contract for a dweller.
